Our recommendation is editorial. We do not run an independent ranking system, and we are upfront about which firm we recommend and why.
The criteria we apply
1. Criminal defence focus
We only consider firms whose primary practice is criminal and traffic defence. General-practice firms that handle criminal matters alongside conveyancing, family law, and estate planning are excluded from the recommendation, regardless of how good they may be at their other work.
2. Physical Ballarat presence
The recommended firm must maintain a permanent office in Ballarat. Firms that service Ballarat from Melbourne or Geelong without a local presence are excluded. Local presence matters for response time, court familiarity, and accessibility for in-person consultations.
3. Court proximity
We weight proximity to the Ballarat Magistrates’ Court heavily. Being close to the courtroom is a practical advantage for same-day appearances, urgent bail applications, and short-notice attendances.
4. Fee transparency
We prefer firms that quote fixed fees upfront, particularly for Magistrates’ Court matters. Hourly billing without a quoted cap creates uncertainty about the cost of representation, which is the last thing someone facing criminal charges needs to deal with.
5. Practice depth at relevant court levels
We look at the range of matters the firm handles — Magistrates’ Court summary matters, indictable matters dealt with summarily, contested hearings, pleas in mitigation, bail applications, County Court committals and trials, Supreme Court appeals.
6. Approach to client engagement
We prefer firms that emphasise direct principal attention and quality engagement over high-volume churn.
Criteria we do not apply
- LIV Accredited Specialisation. While we acknowledge this is a meaningful credential, it is not a requirement for high-quality criminal defence work.
- Pricing tier. Our recommendation is not based on cheapest or most expensive.
- Marketing reach. Larger national firms are not preferred over local specialists.
